GUARDIAN ROLE ACKNOWLEDGMENT & NON-ENFORCEMENT DECLARATION

1. PURPOSE

This declaration confirms that the undersigned Guardian has been informed of, understands, and agrees to operate within the defined role of a Bayside Property Guardians patrol personnel member.

The purpose of this document is to ensure clear legal boundaries, promote safe operational conduct, and reduce risk to clients, staff, and the Company.

2. ROLE CLARIFICATION

I acknowledge and understand that my role as a Guardian is to:

• Conduct patrols and property checks.

• Observe and document conditions or incidents.

• Report suspicious or unlawful activity to appropriate authorities.

• Assist with emergency coordination within approved limits.

• Act as a professional witness where required.

I acknowledge that my role is based on presence, observation, documentation, and communication.

3. NON-ENFORCEMENT STATEMENT (CRITICAL)

I expressly acknowledge and agree that:

☐ I am NOT a police officer, law enforcement officer, or authorised security enforcement officer.

☐ I have NO authority to arrest, detain, restrain, or physically intervene with any person.

☐ I must NOT confront, challenge, pursue, or engage suspected offenders.

☐ I must prioritise my safety, client safety, and public safety at all times.

☐ In situations involving suspected criminal behaviour, my role is limited to observing, documenting, and contacting emergency services.

4. PROHIBITED CONDUCT

I understand that I must NOT:

• Represent myself as law enforcement.

• Use force or threaten force.

• Pursue individuals on foot or by vehicle.

• Enter unsafe premises or scenes unnecessarily.

• Act outside documented company procedures.

5. INCIDENT RESPONSE OBLIGATION

I acknowledge that in the event of suspicious behaviour or intruders I must:

• Move to a safe location.

• Contact emergency services when appropriate.

• Record factual observations only.

• Follow ServiceM8 documentation procedures.

• Notify supervisors as required.

6. COMPLIANCE WITH POLICIES

I confirm that I have received, read, and understood:

7. ACKNOWLEDGMENT OF CONSEQUENCES

• Removal from patrol duties

• Disciplinary action

• Termination of employment or engagement

• Personal liability where conduct falls outside authorised duties

8. LEGAL & LIABILITY DISCLAIMER

I acknowledge that this declaration forms part of the Company’s compliance and risk management framework and may be relied upon in legal, insurance, or regulatory proceedings as evidence of role understanding and operational training.
