Terms & Conditions – Bayside Property Guardians

 

1. Agreement Overview

These Terms & Conditions govern the provision of services by Bayside Property Guardians (“BPG”, “we”, “our”, or “us”) to the client (“you”, “your”).

By subscribing to or using our services, you agree to be bound by these terms.

 

2. Nature of Services

BPG provides a property protection, emergency response, and concierge-style coordination service designed to assist in protecting and managing residential properties.

Our services may include:

  • Security patrols and property checks

  • Emergency attendance and initial response

  • Risk assessment and safety stabilisation

  • Coordination of licensed trades and service providers

  • Property monitoring and preventative maintenance reporting

  • Optional add-on services as selected by the client

 

Important:

BPG is not a building contractor, repair company, insurer, or maintenance provider.

Our role is to respond, assess, make safe where reasonable, and coordinate qualified professionals where specialist works are required.

 

3. Emergency Response Services

Emergency attendance includes:

  • Rapid response to reported incidents

  • Initial assessment of risks and hazards

  • Reasonable actions to minimise further damage

  • Coordination of licensed trades where required

 

Emergency response does not include:

  • Major repairs or replacement works

  • Structural rebuilding or renovations

  • Ongoing trade labour beyond initial stabilisation

  • Any services requiring specialist licensing unless performed by third-party licensed contractors

 

4. Trades & Third-Party Contractors

Where repairs or specialist works are required:

  • BPG may organise or recommend third-party licensed trades.

  • All repair contracts are directly between you and the contractor.

  • Costs for repairs or works are separate from membership fees.

  • BPG does not guarantee pricing or outcomes of third-party contractors, though we aim to use trusted providers.

 

5. Membership Fees & Included Service

Membership fees cover:

  • Access to BPG services as outlined in your selected package

  • Emergency response attendance

  • Security patrols and inspections (where applicable)

  • Coordination and management services

 

Membership fees do not include:

  • Materials, replacement parts, or repair labour

  • Major construction works

  • Insurance excesses or claim costs

6. Service Limitations

BPG services are provided on a reasonable efforts basis.

While we aim to respond promptly, response times may vary due to:

  • Weather conditions

  • Traffic or emergencies outside our control

BPG does not guarantee prevention of loss, theft, damage, or criminal activity.

 

7. Client Responsibilities

You agree to:

  • Maintain appropriate home and property insurance

  • Ensure utilities and infrastructure are safe and compliant

  • Follow recommendations provided after incidents or inspections

 

8. Liability Limitations

To the maximum extent permitted by law:

  • BPG is not liable for indirect, incidental, or consequential losses.

  • BPG’s liability is limited to the value of membership fees paid for the relevant period.

  • BPG is not responsible for pre-existing defects, hidden damage, or failures beyond our control.

Nothing in these terms excludes rights that cannot legally be excluded under Australian Consumer Law.

 

9. Membership Flexibility & Cancellation

  • Memberships may be cancelled at any time unless otherwise agreed.

  • Where annual payments are made in advance, unused portions may be refunded in accordance with your membership agreement.

  • Discounted plans may be adjusted if cancelled early according to agreed pricing terms.
